(a)   The maximum speed limit on the following streets shall be designated as 35 miles per hour:

(1)   Harry Street (Old Highway 54) from the east city limits to the west city limits

(b)   The maximum speed limit on the following streets shall be designated as 30 miles per hour:

(1)   Main Street from the south extended line of Able Street north to the south line of “Old Highway 54”

(c)   The maximum speed limit on the following streets shall be designated as 20 miles per hour:

(1)   Main Street from the south extended line of Able Street south to the City Limits

(2)   Main street from Dold to Loomis, on Loomis from Main to Dold and on Dold from Main to Loomis the maximum speed limit shall be designated as 20 miles per hour (the streets bordering what is commonly known as Ternes Park)

(c)   The maximum speed limit on the following streets shall be designated as 15 miles per hour:

(1)   All Streets in the Pretty Flowers and Trail Ridge additions

(d)   The following streets are designated as “Children at Play” Streets and the maximum speed limit shall be designated as 10 miles per hour:

(1)   Ave D Ct from Main to Cul de Sac

(2)   Mary from Main to Loomis

(3)   N Sedgwick from Garnett to Lavern

(4)   N Main from Garnett to Lavern

(5)   Irene from Main to Sedgwick

(6)   Lavern from Main to Sedgwick

(a)   The 20 mile per hour school zone speed limit shall be in effect in the school zone on Section Line Road (AKA 295th West) in the City of Garden Plain during the following times:

7:45 A.M. – 8:15 A.M.

3:15 P.M. – 4:00 P.M.

Said school zone is located at a point starting approximately 320 yards south of West Harry (AKA Old Highway 54) and ending at a point approximately 485 yards south of West Harry in the City of Garden Plain.

(a)   It shall be unlawful for any person to drive/operate a truck and/or other commercial vehicle with a manufacturer’s rated capacity over one and one half (1.5) ton upon any street unless such street is designated as a truck route in subsection (b) below and posted as such with an appropriate sign. Provided, however, that nothing contained herein shall prohibit such trucks and/or commercial vehicles from driving/operating on streets not designated as truck routes in subsection (b) below and posted as such with an appropriate sign for the purpose of making deliveries to, picking up trash from, or otherwise providing service to and/or seeking services from a premises located on the streets not designated as truck routes. Such truck and/or commercial vehicle which leaves the designated truck route for one of the purposes set forth above shall travel the shortest and most direct route available to and from their destination, provided, however, that said truck and/or commercial vehicle which leaves the designated truck route for such purpose and continues on such street in a manner which would constitute a violation of this section, shall not be deemed in violation of this section.

No such truck and/or commercial vehicle, as described above, shall be allowed to park or be stored on any street not designated as a truck route.

(b)   The following streets are hereby designated as truck routes.

(1)   Main Street between Harry Street (15th South) and the south city limits of Garden Plain, Kansas;

(2)   Section Line (295th West) from the north city limits to the south city limits of Garden Plain, Kansas;

(3)   Harry Street (15th South) from the east city limits to the west city limits of Garden Plain, Kansas.

(c)   Any driver or operator of a vehicle that is found guilty of this section shall be issued a traffic infraction citation. The fine for this infraction is $25.00 plus court costs.

(a)   Recreational Vehicle shall mean a vehicle or a unit that may be independently motorized or may be motorized on or drawn by another vehicle which is primarily designed for temporary living or occasional use. Recreational Vehicle includes travel trailers, camping trailers, truck campers, converted buses, motor homes, fifth-wheelers, boats, boat trailers and unattached utility trailers.

(b)   It shall be unlawful for any owner or operator of a recreational vehicle and/or utility trailer to park such vehicle and/or utility trailer or any highway, street or alley within the corporate limits of the City of Garden Plain, Kansas, for longer than two days for the purpose of storage of such recreational vehicle and/or utility trailer. For purposes of this section, “storage” is hereby defined to be the non-use of such recreational vehicle and/or utility trailer as designed or intended.

(c)   Temporary parking by permit. For the purpose of visiting family or friends living within the City of Garden Plain, Kansas, any owner or operator of a recreational vehicle may apply for a temporary parking permit to park said recreational vehicle on certain streets in the City of Garden Plain, Kansas. Said parking permit shall be issued through the office of the city clerk for a permit fee of $12.00 and shall be for a temporary basis not to exceed 12 days. Such permit to park shall be issued only for the duration of time and for the purposes heretofore stated in this section. It shall be unlawful for any owner or operator to apply for more than two parking permits per year for any one recreational vehicle and at least 30 days must elapse between the end of the first and beginning of the second permit.

(d)   Any owner or operator of a recreational vehicle found in violation for the purposes heretofore stated in this section shall be issued a citation and fined Twenty Dollars ($20.00).

(a)   Careless driving is the operation or halting of any vehicle in such a manner to indicate a careless or heedless disregard for the rights or safety of others, or in such a manner as to endanger, or be likely to endanger, any person or property.

(b)   Any person convicted of careless driving shall be punished by a fine not to exceed $500.00

Whenever the person in possession or control of any private property used by the public for purposes of vehicular traffic by permission of the owner, shall cause to be posted at each entrance thereto a permanently lettered clearly legible sign with the following legend:

“TRAFFIC REGULATIONS OF THE CITY OF GARDEN PLAIN ENFORCED ON THIS PROPERTY, SPEED LIMIT 10 M.P.H., OR AS POSTED”

Then such private property shall thereafter be deemed to be under the traffic regulations of the city as provided by law.
