AN ORDINANCE EXEMPTING THE CITY OF GARDEN PLAIN, KANSAS, FROM K.S.A. 15-209, AND CREATING THE OFFICE OF THE CITY ADMINISTRATOR, PROVIDING FOR THE APPOINTMENT OF A CITY ADMINISTRATOR, AND SETTING FORTH THE DUTIES, RESPONSIBILITIES AND LIMITATIONS OF A CITY ADMINISTRATOR.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDEN PLAIN,

SECTION l. The City of Garden Plain, Kansas, by the power vested in it, under the appropriate Kansas law, elects to make inapplicable to it, and exempt itself from K.S.A. 15-209, insofar as said section applies to the appointment of nonresidents of the City as City Officers, subject to the other provisions of this ordinance.

SECTION 2. There is hereby created the position of City Administrator. Such administrator shall be appointed by the Mayor, with the consent of the Council, and may be removed from office as provided for other City appointees.

SECTION 3. The City Administrator shall be a resident of the State of Kansas.

SECTION 4. The same person may hold the office of City Clerk and City Administrator, or City Treasurer, and City Administrator.

SECTION 5. The City Administrator shall, subject to the approval of the City Governing Body, and except only as otherwise provided by law or the City Ordinances, perform the following duties, powers and responsibilities:

a.    He shall make recommendations as to the hiring and firing of City Employees and officers.

b.    He shall make suggestions as to the direction and control of all municipal departments and areas of municipal concern.

c.    He shall prepare and submit to the Governing Body annual and periodic budgets at such times as may be directed by the Governing Body, and, in any event well in advance of any time required for submission of same under State law.

d.    He shall prepare all forms authorized or required by State or Federal Governments.

e.    He shall keep the Governing Body advised at all times as to all possible grants or other benefits which may inure to the City.

f.     He shall keep the Governing Body advised as to any and all municipal changes and improvements which he feels may be of benefit to the municipality.

g.    He shall reveal and discuss with the council all municipal revenue, expenses and costs, and shall make recommendations to the Governing Body relating to the same.

h.    He shall have the responsibility and authority of entering into discussions with the Governing Body on all policy related matters, and to review policy questions upon the request of the Mayor or the Governing Body. The Administrator shall have the authority to initiate policy recommendations.

i.     He shall keep the City Council fully and punctually advised as to the financial condition and needs of the City and shall have a seat, but no vote, in all public or executive meetings of the Governing Body.

j.     He shall attend all meetings of the Governing Body and upon request of the City Governing Body, meetings of committees of the Governing Body.

k.    The City Administrator shall coordinate the duties of the respective City officials and employees, and shall request and receive from said officials and employees, such information as deemed necessary to carry out the purpose of his duties and responsibilities. He shall also coordinate communications and controls from the Governing Body to the various City employees and officers.

l.     The City Administrator shall investigate all complaints in relation to matters concerning the administration of the Government of the City and its services.

m.   The City Administrator may, with the consent of the Council, act as a purchasing agent for the City to coordinate and consolidate departmental purchases and, whenever practical, receive competitive bids for materials, services, supplies and equipment. All quotations and invoices for equipment, supplies and services shall be referred to the Governing Body for approval and purchase and authorization as deemed appropriate.

n.    The Administrator shall recommend rules and regulations to govern all expenditures, which rules and regulations shall be effective upon the approval of the Governing Body. The Administrator shall coordinate all expenditures of money, if possible, so as not to impair the investment of any idle funds of the City.

o.    The City Administrator shall make studies, analyses, and reports in order that the Governing Body may adopt such measures as it deems necessary or expedient for the health, safety, or welfare of the City, or for the improvement of municipal services.

p.    The City Administrator shall submit reports in order that the Governing Body may determine that the terms and conditions of all franchises, permits and privileges granted by the City are faithfully observed and exercised by the holders thereof.

q.    The City Administrator shall establish an adequate system of records that will currently reflect the status and utilization of all City owned lands, personal property, building, equipment and other municipal assets in order that the Governing Body may insure proper maintenance, utilization and knowledge pertaining thereto.

r.     He shall make recommendations to the Governing Body of a schedule of salaries for all officers and employees.

s.     He shall recommend the administrative responsibilities therefor, prepare job descriptions, provide a disciplinary plan, grievance procedures and other appropriate and necessary rules and regulations for the governing of the personnel policies of the City. These plans shall be submitted to the Governing Body for approval.

t.     He shall perform such other duties as the Governing Body may from time to time direct. He shall promulgate personnel rules and regulations.

SECTION 6. Notwithstanding any other clauses herein to the contrary, the rights, authorities, duties and responsibilities granted to the City Administrator hereunder, shall in no way limit the legal rights, powers and responsibilities of the Governing Body.

SECTION 7. The City Administrator shall receive a salary not to exceed $15,000.00 per annum, or such greater sums as may be subsequently established by the Governing Body, and shall give security bond, at the City’s expense, in such form as the City may require for the faithful performance of his duties.
