A CHARTER ORDINANCE EXEMPTING THE CITY OF GARDEN PLAIN, KANSAS, FROM CERTAIN PROVISIONS OF K.S.A. 75-1117, et seq., SO AS TO PERMIT THE CITY THE RIGHT TO HAVE THEIR ACCOUNTS EXAMINED AND AUDITED EVERY OTHER YEAR INSTEAD OF ONCE EACH YEAR AS REQUIRED UNDER SAID STATUTES, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDEN PLAIN, KANSAS:

SECTION l. The City of Garden Plain, Kansas, hereby exempts itself from the requirements of K.S.A. 75-1117, et seq., and in particular 75-1120, which statutes require the City in part “…to have their accounts examined and audited at least once each year ...”. Instead, the  City shall have their accounts examined and audited every other year and as follows:

A.   Gas, sewer and any other utility funds shall be examined and audited every other year beginning with the calendar year 1982.

B.    All other funds, including, but not limited bond and interest, employee benefit, law enforcement, fire, special street and highway and revenue sharing, shall be examined and audited  every other year beginning with the calendar year 1983.

SECTION 2. The City feels that it is to the best interests of the City from an economic standpoint that it exempt itself as hereinabove provided from the provisions of said statutes as stated above. The statutes, excepting only as  provided above, shall remain in full force and effect and shall, in fact, apply to the City of Garden Plain.
