(a)   The following are designated as main trafficways of the city pursuant to K.S.A. 12-685 et seq. for purposes of bond financing certain improvements:

(1)   Garnett Avenue, Dold Drive and Commerce St.;

(2)   Main Street and D Avenue;

(3)   West Street; Abel Street; Doyle Street; Biermann Street; Santa Fe; Mary Avenue; Sedgwick Street; Loomis Street; Avenue C; Avenue B.

(a)   The City of Garden Plain, Kansas, hereby creates and establishes an “Employee Benefit Contribution Fund.”

(b)   Said fund shall be utilized for the purpose of paying the employer’s share of the following employee benefits, exclusive of any salaries, wages, or other direct payments to such employees, i.e., social security, workmen’s compensation, Kansas Public Employee’s Retirement expenses, and unemployment compensation.

(c)   There is hereby levied an annual tax upon all taxable property within the City in an amount equal to 1.045 mills, which sum shall be necessary to carry out the purposes of the employee benefits contribution fund.

(d)   If for any reason the employee benefits above itemized for any reason, fail to comply with the legal requirements of K.S.A. 12-16102, then said benefits shall not be paid and the tax levied herein shall be reduced accordingly.

(a)   A majority of the electors voting thereon having approved, at a special question election held on the 2nd day of November, 2021, the levying of a retailers’ sales tax in the City of Garden Plain, for the purposes of providing tax relief, financing the cost of needed public economic development initiatives, and such other general purposes, as authorized by K.S.A. 12-187 et seq., and amendments thereto, there is hereby levied a city retailers’ sales tax in the amount of one percent (1%) to take effect on the 1st day of April, 2022.

(b)   Except as otherwise provided by law, such tax shall be identical in its application and exemptions therefrom to the Kansas Retailers’ Sales Tax Act and all laws and administrative rules and regulations of the Kansas Department of Revenue relating to the state retailers’ sales tax shall apply to such city retailers’ sales tax insofar as such laws and regulations may be made applicable. The services of the Kansas Department of Revenue shall be utilized to administer, enforce and collect such tax.

(a)   Authorization to collect debt owing to the City of Garden Plain, Kansas:

The City of Garden Plain, Kansas is hereby authorized to charge and to collect the reasonable costs of collection of any fine(s)/fee(s)/costs of services, as well as any cost or assessments for clean-up of the property for a municipal violation that is the issue herein. This specifically applies to, but is not limited to, charges for water, trash, sewer, property code violation fines, parking tickets, municipal court fines, fees, court costs, interest accrued thereon, and any other debt due and owing to the municipality. The costs of collection include, but are not limited to, court costs, surcharges, attorney fees, and collection agency fee, except that such costs of collection may not include both attorney fees and collection agency fees.

(b)   Citizen/Debtor duty to pay City of Garden Plain for collection costs:

Every Citizen/debtor owing fine(s)/fee(s)/costs of services to the City of Garden Plain, Kansas, shall pay any and all charges related to the reasonable costs of collection of any such fine(s)/fee(s)/costs of services, as well as any cost or assessments for clean-up of the property for a municipal violation that is the issue herein. This specifically applies to, but is not limited to, charges for water, trash, sewer, property code violation fines, parking tickets, municipal court fines, fees, court costs, interest accrued thereon, and any other debt due and owing to the municipality. The costs of collection include, but are not limited to, court costs, surcharges, attorney fees, and collection agency fee, except that such costs of collection may not include both attorney fees and collection agency fees.

(a)   Pursuant to the provisions of K.S.A. 12-1, 118, there is hereby established a Capital Improvement Fund for the City of Garden Plain, Kansas which may be used to finance in whole or in part any public improvement need set forth in the City’s adopted Capital Improvement Plan. Said fund may be composed of monies transferred from other City funds available for capital improvement purposes. Reimbursements may also be made to such fund from bond proceeds, special assessments, or state or federal aid available for completed projects. Any monies so transferred and credited to such fund shall not be subject to the provisions of K.S.A. 79-2925 through 79-2937, and amendments thereto.

(b)   For the purpose of this section, Capital Improvements shall include but are not limited to repair, restoration, and rehabilitation of existing public infrastructure and facilities, and for engineering and other advance public improvement plans and studies.

(c)   Investment of Funds. Monies in the Equipment Reserve Fund shall be invested in accordance with the provisions of K.S.A. 10-131, and amendments thereto, with interest earned thereon credited to such fund.

(a)   Pursuant to the provisions of K.S. A. 12-1, 117, there is hereby established an Equipment Reserve Fund for the City of Garden Plain, Kansas which shall be used to finance the acquisition of equipment necessary for the performance of the various functions and services of the City of Garden Plain, Kansas. Said fund may be composed of monies transferred from other City funds. Any monies so transferred to such fund shall not be subject to the provisions of K.S.A. 79-2925 through 79- 2937, and amendments thereto.

(b)   For the purpose of this section, Equipment shall include machinery, vehicles, and other equipment or personal property including, but not limited to, computer hardware and software, which the City is authorized to purchase for municipal purposes.

(c)   Investment of Funds. Monies in the Equipment Reserve Fund shall be invested in accordance with the provisions of K.S.A. 10-131, and amendments thereto, with interest earned thereon credited to such fund.
