CHARTER ORDINANCE EXEMPTING THE CITY OF GARDEN PLAIN. KANSAS. FROM CERTAIN PROVISIONS OF SECTION 15-209 OF THE GENERAL STATUTES OF KANSAS RELATING TO AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS FOR THE APPOINTMENT OF CITY CLERK
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDEN PLAIN. KANSAS:
SECTION 1. The City of Garden Plain, a mayor-council city of the third class by the power vested in it by Article 12 Section 5, of the Constitution of the State of Kansas, hereby elects to and does exempt itself from certain provisions of Section 15-209 of the Kansas Statutes Annotated relating to the qualifications of the office of City Clerk for cities of the third class.
SECTION 2. The City Clerk of the City of Garden Plain. Kansas, appointed under appropriate laws of the State of Kansas, shall not be required to be a resident of the City of Garden Plain, Kansas, but shall be a qualified elector of the State of Kansas and shall be required to live at least within a ten-mile radius of the city limits. The City Clerk shall be required to relocate to within the ten-mile radius within six months from the date of appointment.
SECTION 3. All of the Provisions of K.S.A. 15-209 not otherwise conflicting with this ordinance shall remain in full force and effect. This ordinance shall be published once each week for two consecutive weeks in the official city newspaper.
