A CHARTER ORDINANCE EXEMPTING THE CITY OF GARDEN PLAIN, KANSAS, FROM THE PROVISIONS OF K.S.A. 79-5028 AS AMENDED, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT INCREASING THE RATE LEVY LIMIT.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARDEN PLAIN, KANSAS:

Section 1. The City of Garden Plain, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas and as provided by K.S.A. 79- 5036(a) as amended, hereby elects to exempt itself from the provisions of K.S.A. 79-5028. K.S.A. 79-5028 is part of an enactment commonly known as the Kansas property tax lid law, which enactment applies to this city but does not apply uniformly to all cities.

Section 2. The following is added to the provisions of K.S.A. 79-5028: (i) the levy of taxes by the Governing Body of the City of Garden Plain, Kansas, for the Library Fund as authorized by K.S.A. 12-1220 to the extent of 4 mills.
